My New Year's Is 62 Million Times Bigger Than Yours, Said The Man From Beijing

The New Year comes, of course, at midnight. But because we have different time zones, we have many different midnights and some are much more crowded than others.

This morning I asked myself: who's got the biggest New Year's Eve on earth? By which I mean: which time zone has the most people in it. And the answer is clear.

If you look at this world time zone map, one zone, which we've highlighted it in yellow has, as you can see, all of China, all 1.3 billion of 'em, plus a hunk of Siberia, plus Taiwan, Hong Kong, the Philippines, Malaysia, Singapore, Brunei, a chunk of Indonesia, Timor and a cut of Australia. Altogether, that's got to be at least 1.5 billion people who will greet 2012 at the very same moment.

Party-wise (assuming Confucian cultures pay our New Year's eve any mind, and I think they do), this is the hot and poppin' New Year's Eve Zone on our planet, bigger than the zone that transects Western Europe and Africa, bigger than anything in the Americas.

For Those Who Don't Go Out on New Year's...

But maybe you're the quiet type. Maybe you don't like a lot of noise and merry making on what is a purely odometer-like occasion. And maybe you are looking for a time zone that is next to empty where there's nobody around to irritate you. Well, I think we've got a zone for you.

This zone is two zones west of the Greenwich meridian. It is mostly empty ocean.

Yes, it does contain a hunk of Greenland, a bit of Brazil, and a few Atlantic islands (the Azores) but all those places have chosen ? and passed laws, attaching themselves to other time zones. They've opted out. So not a lot of people live in this zone's time. It's a vast stretch of uninhabited Atlantic, populated only by fish and whales who don't have, I presume, a special feel for Decembers or Januaries or clocks or midnights. It does, down near Antarctica, include two little dots of land: the South Georgia and the South Sandwich islands, but they don't, either of them, have many inhabitants. One website I looked at estimates a research population of about 24 people, in the summer months (which is around now).

No Need For Velvet Ropes

Meaning, if you invited everybody in this time zone (not including transient boat traffic, penguins or seals), the biggest crowd you could hope for is two dozen people.

So there you have it, two very different zones for different temperaments. And the differences aren't trivial: 1.5 billion people here, 24 people there.

That's the Chinese advantage over South Sandwich Island. Their zone has 62.5 million times more people. But here's the South Sandwich advantage (for shy people): their zone is 62.5 million times less crowded. Whichever way you like it, happy New Year!

Box Office Preview: 'M:I4' to tower over others (AP)

LOS ANGELES ? The final box office weekend of 2011 should be led by Tom Cruise in "Mission: Impossible ? Ghost Protocol," with a not impossible domestic gross near $35 million for the four-day New Year's weekend.

The Paramount film led the Christmas weekend after its limited debut in IMAX gave it a big marketing boost, and this week's midweek numbers indicate audience interest is holding, with a total North American gross of about $130 million expected by Monday night.

Warner Bros.' "Sherlock Holmes: A Game of Shadows," starring Robert Downey Jr. and Jude Law, will enter its third weekend after crossing the $100 million mark on Wednesday, and clues point to another $25 million for the long holiday weekend.

Fox's "Alvin and the Chipmunks: Chipwrecked" should have a chipper third weekend in the low $20 million range as families enjoy the last of the holidays together before it's back to school. By Monday night, the little rodents should have munched a total of about $90 million.

Sony's thriller "The Girl With the Dragon Tattoo," the second film adaptation of the hugely popular mystery novel by Stieg Larsson, hacked $20 million from audiences over the extended Christmas holiday and enters New Year's weekend with a potential gross in the mid- to high-teens.

Disney's "War Horse" opened Christmas Day with $7.5 million and will now stretch its legs over a full holiday weekend with a likely gross in the $15 million range. The Steven Spielberg film is based on the 1982 children's novel and the 2007 stage adaptation, and has received two Golden Globe nominations, including for best picture.

U.S. Blacks More Likely to Die of Colon Cancer Than Whites: Study (HealthDay)

FRIDAY, Dec. 30 (HealthDay News) -- Although colorectal cancer death rates in the United States have fallen across the board over the last 20 years, the dip has been smaller among blacks than whites, a new study indicates.

Specifically, the racial spread in death rate trends appears to be most notable among patients diagnosed with the most advanced stage of the disease, according to the results of an investigation by the American Cancer Society (ACS).

"The widening racial disparity for [advanced]-stage has a disproportionate impact on overall colorectal cancer mortality disparities because [advanced]-stage accounts for approximately 60 percent of the overall black-white mortality disparity," the study authors explained in an ACS news release.

The study team, led by Dr. Anthony Robbins, pointed out that up until 1980, black Americans were actually less likely to die from colorectal cancer overall than whites. Since then, however, the availability of ever-better screening and treatment options has turned that dynamic on its head. The result: by 2007, the rate of death among blacks was 44 percent greater than that among whites.

The reason, the authors suggested, may be that black patients do not seem to be getting screened or treated as often and as aggressively as white patients.

The aim of the current ACS study was to find out how exactly racial differences in plummeting death rates have been playing out with respect to disease progression: namely, early-stage (in which cancer is localized); mid-stage (in which cancer has spread to regional lymph nodes); and late-stage (in which the cancer is made its way throughout the patient's body).

To explore that question, the team analyzed two decades of information that had already been gathered by the U.S. National Cancer Institute's Surveillance, Epidemiology, and End Results (SEER) Program database.

The review, released online Dec. 19 in advance of print publication in the Journal of Clinical Oncology, revealed that while racial differences in death rate declines were apparent at every stage of disease, the divide was most stark among late-stage patients.

For example, while early-stage white patients experienced a roughly 30 percent drop in death rates over the last 20 years, their black peers experienced about a 13 percent decline. Among mid-stage patients, the drop was almost 49 percent among whites versus 34 percent among blacks.

But for those with the most advanced stage of disease, the gap was even greater: death rates had dropped by nearly 33 percent among whites compared with just under 5 percent among blacks, the investigators found.

The authors noted that black Americans tend to be screened less often, are less likely to have timely follow-ups when they are screened, and are generally less well informed when it comes to the latest and best treatment options. The researchers suggested that to rectify the problem, an effort should be made to bump up early-stage detection of colorectal cancer among black patients.

Correction: Green Jobs-Veterans story (AP)

COLUMBUS, Ohio ? In a Nov. 26 story about renewable-energy jobs for military veterans, The Associated Press quoted former Marine Ben Noland as saying he served two tours in Iraq and one in Afghanistan. Based on information from Noland, the story also said he served eight years in the Marines.

According to Marine Corps spokeswoman Maj. Shawn Haney, Noland's records show he was stationed in Kuwait, not Iraq and Afghanistan. Haney also said Noland served four years on active duty and four in Individual Ready Reserve. During Ready Reserve, a Marine can be called back to active duty. But he is not considered to be serving in the Marines during that period, according to Haney.

(SALT LAKE CITY) Arrhythmia is a potentially life-threatening problem with the rate or rhythm of the heartbeat, causing it to go too fast, too slow or to beat irregularly. Arrhythmia affects millions of people worldwide.

The cardiac conduction system (CCS) regulates the rate and rhythm of the heart. It is a group of specialized cells in the walls of the heart. These cells control the heart rate by sending electrical signals from the sinoatrial node in the heart's right atrium (upper chamber) to the ventricles (lower chambers), causing them to contract and pump blood.

The biologic and genetic mechanisms controlling the formation and function of the CCS are not well understood, but new research with mice shows that altered function of a gene called Tbx3 interferes with the development of the CCS and causes lethal arrhythmias.

In a study published in the Dec. 26, 2011, Proceedings of the National Academy of Sciences early edition, researchers led by the University of Utah showed the CCS is extremely sensitive to levels of Tbx3. Mouse embryos with Tbx3 levels below a critical threshold suffered arrhythmia and couldn't survive. As the levels of Tbx3 were increased, mice survived to birth, but as adults they developed arrhythmias or had sudden death.

Tbx3 dysfunction merits further investigation as a cause of acquired and spontaneous arrhythmias, says Anne M. Moon, M.D., Ph.D., adjunct professor of pediatrics at the U of U School of Medicine and corresponding author on the study. "The cardiac conduction system is very sensitive to Tbx3," Moon says. "Tbx3 is required for the conduction system to develop, mature, and then continue to function properly."

The Tbx3 protein, which is a transcription factor encoded by the TBX3 gene, has been linked to heart development, but its role is not yet clearly defined. Moon and her colleagues, including first author Deborah U. Frank, M.D., Ph.D., U assistant professor of pediatrics, found that slight alterations in the structure of the Tbx3 gene alter the level of the protein in mice. When this happens, it can impair the electrical signal in the sinoatrial node and block the atrioventricular node, which conducts electrical signals from the atria to the ventricles. The result is lethal arrhythmias in embryonic and adult mice.

This discovery has implications for the potential to regenerate functional heart tissue, according to Moon. "There's a big effort to regenerate heart muscle," she says. "But if the muscle can't conduct electrical signals, it's not going to do any good; we also need to be able to regenerate conduction tissues to regulate that muscle."

Arrhythmia is not the first problem related to mutations in the TBX3 gene. In humans, TBX3 mutations have been shown to cause limb malformations in people with ulnar-mammary syndrome, an inherited birth disorder characterized by abnormalities of the bones in the hands and forearms and underdeveloped sweat and mammary glands.

In her future research, Moon wants to discover specifically how Tbx3 regulates the behavior of cells in the cardiac conduction system and whether cells that don't have enough Tbx3 die or turn into some other kind of cells.

"It turns out that Tbx3 is a lot more important in the heart than we realized," Moon says.

Web gambling gets boost from Obama administration (Reuters)

WASHINGTON (Reuters) ? The Obama administration cleared the way for states to legalize Internet poker and certain other online betting in a switch that may help them reap billions in tax revenue and spur web-based gambling.

A Justice Department opinion dated September and made public on Friday reversed decades of previous policy that included civil and criminal charges against operators of some of the most popular online poker sites.

Until now, the department held that online gambling in all forms was illegal under the Wire Act of 1961, which bars wagers via telecommunications that cross state lines or international borders.

The new interpretation, by the department's Office of Legal Counsel, said the Wire Act applies only to bets on a "sporting event or contest," not to a state's use of the Internet to sell lottery tickets to adults within its borders or abroad.

"The United States Department of Justice has given the online gaming community a big, big present," said I. Nelson Rose, a gaming law expert at Whittier Law School who consults for governments and the industry.

The question at issue was whether proposals by Illinois and New York to use the Internet and out-of-state transaction processors to sell lottery tickets to in-state adults violated the Wire Act.

But the department's conclusion would eliminate "almost every federal anti-gambling law that could apply to gaming that is legal under state laws," Rose wrote on his blog at www.gamblingandthelaw.com.

If a state legalized intra-state games such as poker, as Nevada and the District of Columbia have done, "there is simply no federal law that could apply" against their operators, he said.

The department's opinion, written by Assistant Attorney General Virginia Seitz, said the law's legislative history showed that Congress's overriding goal had been to halt wire communications for sports gambling, notably off-track betting on horse races.

Congress also had been concerned about rapid transmission of betting information on baseball, basketball, football and boxing among other sports-related events or contests, she summarized the legislative history as showing.

"The ordinary meaning of the phrase 'sporting event or contest' does not encompass lotteries," Seitz wrote. "Accordingly, we conclude that the proposed lotteries are not within the prohibitions of the Wire Act."

The department expressed no opinion about a provision in the law that lets prosecutors shut down phone lines where interstate or foreign gambling is taking place.

Many of the 50 U.S. states may be interested in creating online lotteries to boost tax revenues and help offset the ripple effect of a federal deficit-reduction push.

The global online gambling industry grew 12 percent last year to as much as $30 billion, according to a survey in March by Global Betting and Gaming Consultancy, based on the Isle of Man, where online gambling is legal.

Federal prosecutors in April charged three of the biggest Internet poker companies with fraud and money-laundering along with violations of another federal law, the Unlawful Internet Gambling Act of 1986.

The government outlined an alleged scheme by owners of the three largest online poker companies - Full Tilt Poker, Absolute Poker and PokerStars - to funnel gambling profits to online shell companies that would appear legitimate to banks processing payments.

Dropbox for Android has been updated to support Android 4 (ICS ) and it?s now available in the Android Market. The Beta has been available in their forums for a while for users to test but it?s now it?s official.

I have been trying to move away from Dropbox and other smaller companies cloud storage solutions for the fear of the company shutting down out of the blue one day. I am looking at moving Dropbox services over to Microsoft?s Skydrive but Dropbox makes things so much easier. That?s why I am still stuck on it. I have the free account with only 2gb of storage, but for what I use it for, it?s plenty.

If you are unfamiliar with what Dropbox is, it?s an online storage solution. Failed Martin Luther King Day parade bomber gets 32-year sentence

The white supremacist who pleaded guilty to attempting to bomb a Martin Luther King Day march in Spokane, Wash., was sentenced Tuesday. The FBI says the story?is a cautionary tale about the threat of 'lone wolf' attacks.?

A self-professed white supremacist was sentenced to 32 years in prison on Tuesday after admitting that he left an explosive device in a backpack near the intended route of a Martin Luther King Day Unity March in Spokane, Wash.

The device was packed with 128 0.25-ounce fishing weights coated with the anticoagulant brodifacoum, an active ingredient in rat poison, according to court documents.

The device, discovered on Jan. 17, did not detonate.

Kevin William Harpham of Colville, Wash., was arrested two months later. He pleaded guilty in September to two of four counts in his federal indictment: attempting to use a weapon of mass destruction, and attempting to cause bodily injury with an explosive device because of the race, color, or national origin of a targeted person.

Under the terms of his plea agreement, Mr. Harpham avoided a potential life sentence. Following his 32-year prison sentence, Harpham has been ordered to serve probation for the rest of his life.

Roughly 2,000 people, many of them minorities, were set to participate in the unity parade. The backpack and explosive device were found by alert city workers prior to the event.

Officials say the incident underscores the importance of citizens remaining vigilant. But they add it also points up a lingering vulnerability in the US to homegrown terrorists.

?A prototypical ?lone wolf? such as Mr. Harpham presents a particularly vexing threat ? with nothing foreshadowing a carefully planned attack,? said Laura Laughlin of the FBI?s Seattle office.

Harpham?s device consisted of a steel pipe with one end welded shut and the other open, like a mortar. In addition to the make-shift shrapnel, it was assembled with 100 grams of black powder, a model rocket igniter, and a remote-control triggering system. The device was designed to propel shrapnel out the tube and, allegedly, into the crowd.

The FBI offered a $20,000 reward for information leading to the arrest of the person or persons responsible.

Agents eventually discovered that some of the fishing weights had been purchased using a bank card that belonged to Harpham.

Harpham had no prior criminal record and had served in the US Army from 1996 to 1999. At his sentencing hearing, he tried to withdraw his guilty plea, but the judge would not allow it.

?For most of his 36 years on this planet, he lived an exemplary life,? Federal Defender Kailey Moran wrote in a sentencing memorandum to the judge. ?He cared for others, he worked hard, and paid his debts, and he served his country through military service where he received an honorable discharge.?

Ms. Moran said friends and family described him as ?a kind-hearted and gentle soul who would go to any length to help someone in need.?

Federal agents working on the case discovered a different version of Harpham. They found that he was a member of the National Alliance, a white supremacy group, and that he participated in an online Internet forum at the Vanguard News Network, a white supremacist website. According to the FBI, Harpham used the online moniker ?Joe Snuffy.?

In June 2006, ?Joe Snuffy? posted a disparaging comment about supermodel Heidi Klum and her interracial marriage.?His last posting on the Vanguard News website was Jan. 15, two days before the backpack was discovered, according to the FBI.

Investigators were also able to link Harpham to the backpack by comparing trace DNA found on the handle and shoulder straps of the backpack to a DNA sample on file with the Department of Defense dating from his years of Army service.

When agents raided his home, they discovered racist books and magazines, and information about domestic terrorism, according to prosecutors. They also seized an AK-47 assault rifle, a handgun, and a digital clock that had been modified as a timing device.

?Acts of hate like this one have no place in our country in the year 2011, but yet, unfortunately, we continue to see attempted violence in our communities due to racial animus,? said Assistant Attorney General for Civil Rights Thomas Perez, in a statement.

?This case underscores the continuing threat from those who seek to express their hatred through violence and the serious consequences these individuals face for such actions,? added Lisa Monaco, assistant attorney general for national security.

Texas family rescued from snowdrift in New Mexico

ALBUQUERQUE, N.M. (AP) - Rescuers Wednesday pulled a Texas family from a car that had been buried in a snowdrift for nearly two days on a rural northeastern New Mexico highway.

State police say rescuers had to dig through four feet of ice and snow to free the Higgins family of Santa Fe, Texas, whose red Yukon got stuck on U.S. 56 near Springer when a blizzard moved through the area Monday.

Police say David and Yvonne Higgins and their 5-year-old daughter were clinging to each other and lethargic when they were found about 2:45 Wednesday morning.

The family is recovering at Miners Colfax Medical Center in Raton.

State police say they got a distress call and launched a search for the family Tuesday evening.

The Higgins were among 32 vehicles state police and guardsmen rescued from the storm, but they were the only ones who police say needed medical attention.

(AP) ? Already known as a refuge for people from other lands, New Haven is tightening its embrace of newcomers as its mayor seeks to extend voting rights to illegal immigrants and other noncitizens, a policy challenge that comes shortly after attacks on "sanctuary cities" by Republican presidential candidates.

The Democratic mayor, John DeStefano, helped illegal immigrants come out of the shadows four years ago when he launched a first-of-its-kind program to give them city resident cards. Despite crackdowns elsewhere, he has forged ahead with proposals that he says are designed to find common ground in a diverse city.

"We're a place of differences," he said. "We're a place that sees a strength and places a value on welcoming folks from all over."

Dozens of American cities including New York, San Francisco and Cambridge, Mass., take a hands-off approach to pursuing illegal immigrants. While advocates say they are rightly distancing themselves from a broken immigration system, critics accuse them of flouting federal law as "sanctuary cities" ? a label not all of them accept.

Presidential hopeful Newt Gingrich has vowed to cut off federal funding for such cities. One of his rivals, Texas Gov. Rick Perry, pushed a bill this year that would have prohibited cities from acting as "sanctuaries" for illegal immigrants and allowed local law enforcement to become more involved in immigration enforcement. Mitt Romney has said he opposed sanctuary cities as Massachusetts governor and, as president, he would "find the right approach" to ending them if legally possible.

President Barack Obama has resisted calls from some Republicans to crack down on sanctuary cities. As a Democratic candidate in 2007, he said the U.S. government should address the issue by providing a rational immigration system, not by withdrawing funds from cities that shelter noncitizens.

More than 70 cities and states nationwide bar police from asking community residents who have not been arrested to prove their legal status, according to the Immigration Policy Center, a nonpartisan research organization. For many, including New Haven, the goal is to make immigrants comfortable reaching out to police for help.

Those policies, however, do not prevent state or local police from reporting foreign-born criminals to the Department of Homeland Security.

New Haven, the home of Yale University, is a port city of 125,000 residents with a history of embracing liberal politics and social change. It was a hotbed for civil rights protests in the 1960s and, more than a century earlier, the city where African captives from the slave ship Amistad were jailed before winning their freedom in the 1840s.

The city has an estimated 10,000 to 12,000 illegal immigrants, resettles some 200 refugees annually and hosts roughly 2,000 noncitizens associated with Yale.

DeStefano long ago prohibited police from asking people about their immigration status. In addition to his pledge to seek legislative action allowing illegal immigrants to vote ? a proposal that many, including Democratic Gov. Dannel P. Malloy, see as unrealistic ? the 10-term mayor last week also spoke out against a federal immigration enforcement program, Secure Communities, which uses fingerprints collected in local jails to identify illegal immigrants who have been arrested.

DeStefano brushed off the Republican attacks as irrelevant to his city and suggested critics are using immigrants as scapegoats amid the weak economy.

"These are hard times right now in America," he said. "Part of human nature is when you're angry to look for someone else to blame for your problems. I understand that."

New Haven's immigrant-friendly reputation sets it apart from some other Connecticut communities, including next-door neighbor East Haven, where a U.S. Justice Department investigation found Monday that police had singled out Latinos for harassment and where a criminal investigation by the FBI could lead to indictments of individual officers.

With other states including Arizona, Alabama and South Carolina passing laws aimed at stopping illegal immigration, some newcomers to New Haven are grateful to not be under the same scrutiny.

"Here the police give people a break. If you're caught driving drunk or without a license, you'll still go to court. But they don't call immigration," said Nicolas Gutierrez, a 63-year-old deli worker from Mexico who's a permanent U.S. resident.

Bakery owner Francisco Barranco, however, said some of his customers are concerned that New Haven will receive more attention from federal immigration agents who could see DeStefano's actions as provocation, as many believe they have in the past.

In 2007, the day after New Haven began handing out resident cards to give noncitizens access to community services, U.S. Immigration and Customs Enforcement agents swept through the city and detained 31 immigrants. Critics, including DeStefano, contend the raid was retaliation for the city's adoption of the ID program ? a charge the agency has steadfastly denied.

DeStefano says that noncitizens, including illegal immigrants, already work and pay taxes in the city and that allowing them to vote in municipal elections would encourage them to participate more in the community. His office says that two dozen other states have seen similar legislation and that many cities and towns allow for voting in local elections, but the secretary of the state said it would require an amendment to the state constitution for it to fly in Connecticut.

Connecticut Republican Party Chairman Jerry Labriola has dismissed the proposal as a "publicity stunt," saying it would reward illegal immigration.

The mayor has stronger backing on his stand against the new ICE initiative, Secure Communities, which he says would destroy the trust the city has built up with its illegal immigrants.

Hartford officials have joined him in calling on local officials not to honor detainer requests for immigrants who could be subject to deportation after being picked up for minor violations. And the governor's liaison on criminal justice policy, Mike Lawlor, said the administration shares concerns that illegal immigrants of all stripes will be targeted, and not just serious offenders.

An ICE spokesman, Harold Ort, said the program focuses on criminal offenders. He also noted that once a local law enforcement agency submits fingerprint data to any branch of the federal government, such as the FBI, the state does not have to sign off on that data being shared with other agencies.

DeStefano, for his part, seemed amused by the attention given to his latest proposals.

"When we did the resident card, everybody thought the world was going to explode. The world didn't explode," he said. "We were a stronger place for it."

Why Britney Spears, Bruno Mars Didn't Make Best Artists Of 2011 List

We attempt to explain the madness behind MTV brain trust's methods.

On Thursday, MTV unveiled our picks for the Best Artists of 2011 ... a list fittingly topped by none other than Katy Perry, who bested big-name stars like Nicki Minaj, Adele, the Throne and Lil Wayne to take home the honor.

It wasn't an easy choice, but we'd like to think we got it right. After all, Katy had three #1 singles — with a possible fourth looming on the horizon — this year, took her massive California Dreams Tour to arenas around the world, won Video of the Year at the 2011 VMAs and frequently posed for photo-ops like this. It was a pretty impressive 12 months, to say the very least.

Still, it took a whole lot of back-and-forth from our panel of experts — a brain trust made up of folks from MTV News, MTV Music and Talent and MTV.com — before we could declare Katy our #1 choice ... and needless to say, as we've been unveiling our picks, not all of you agree with our decision. But it seems that most fans don't have a problem with who made our list ... they're taking issue with who didn't.

And for all of the names bandied about by MTV.com readers, it seems that three keep coming up time and time again: Britney Spears, Bruno Mars and Pitbull, artists who each have a legitimate claim at being included in the conversation, if not placing in the top 10. So why didn't they? Let's try to explain.

Before our brain trust met, each department gathered and created a list of their top 12 picks for Best Artist of 2011. Those lists were then compiled, and we used some good old-fashioned arithmetic to determine an overall top 12 (everyone's #1 pick was awarded 12 points, each #12 pick got 1). From there, we debated, eventually settling on the top 10. And here's where the snubs begin: It seems that, while Brit, Bruno and Pit made everyone's top 12, none of them placed high enough to accumulate enough points ... though all three were in the discussion, they each finished toward the bottom of the overall top 12 and, really, we couldn't move them up far enough to make the final 10. And, more specifically, we couldn't find anyone in the top 10 we felt could be taken out.

Why? OK, let's break it down. Though Britney had a big year, our brain trust couldn't get past the fact that the story of her year hadn't changed all that much from previous years. She seemed to still be the princess of pop at the peak of her career, but she didn't necessarily gain any new ground this year. And though her chart-topping "Hold It Against Me" made tons of noise, Adele, Katy and Rihanna had lengthy Billboard reigns that were too difficult to overlook. Still Britney didn't finish entirely empty-handed. Her (really excellent) "Till the World Ends" placed at #10 on Bigger Than the Sound's 25 Best Songs of 2011 list.

As far as Bruno is concerned, he came quite close to cracking the top 10, but the brain trust took issue with the fact that his Doo-Wops & Hooligans album came out last year, not to mention that, outside the success of "Grenade" in early 2011, his subsequent singles didn't reach #1 (though "The Lazy Song" did make it to #4). And if all of that seems like nit-picking, well, some of us on the brain trust would agree with you, but sadly we were out-voted. And when it came to Pitbull, let's just say that while he had a monster hit with "Give Me Everything" (which came in at #6 on the brain trust's Best Songs list), most of the panelists couldn't get past the fact that he never quite got around to matching that song's success ... ubiquitous Dr. Pepper ad campaign aside.

So, there you go. Like we said, putting together a top 10 wasn't easy, and fans of Britney, Bruno and Pitbull probably have some legitimate gripes. Hopefully, explaining the madness behind our methods will help assuage some of their anger. Then again, probably not.

Experts: Corzine avoided missteps in his testimony

(AP) ? Jon Corzine's three days of testimony on MF Global's collapse offered little to satisfy lawmakers or clients who lost millions when the securities firm failed. Yet legal experts say Corzine helped himself by choosing words with care and articulating an explanation that's hard to disprove.

Corzine, a Democratic former senator and governor of New Jersey, told three congressional panels that he never intended to "misuse" client money or order anyone else to do so. He said no reasonable person who worked with him could have concluded otherwise.

He also rebuffed an assertion that he knew about customer money that might have been transferred to a European affiliate just before MF Global collapsed. It could be hard to build a persuasive case that he did know, experts say.

"It's remarkable how he really has narrowly walked that line ? to be able to communicate effectively while preserving his defenses," said Jacob Frenkel, a former enforcement attorney with the Securities and Exchange Commission, one of the regulators investigating MF Global. "He could have hurt himself by testifying. That has not happened."

About $1.2 billion was found to be missing from client accounts when MF Global failed on Oct. 31, becoming the eighth-largest bankruptcy in U.S. history. Much of the missing money belonged to farmers, ranchers and other business owners who used MF Global to reduce their risks from the fluctuating prices of commodities such as corn and wheat.

Brokers such as MF Global generally are required to keep customer money in separate accounts to protect it in case the company fails. MF Global apparently failed to do so. Congress, regulators and criminal investigators are looking into the case.

Those investigations, still in their early stages, will likely yield clearer answers about how client money came to be misused. For now, it remains a mystery.

"I think it was unrealistic for Congress to expect substantive answers to these questions, because no one is that naive," Frenkel said. "That's why these investigations are ongoing ? to figure out what happened to the money and who is responsible."

Some of the lawmakers who questioned Corzine appeared to agree.

"If you did anything wrong, the criminal investigators will find that; I won't," said Massachusetts Rep. Michael Capuano, the top Democrat on the panel Corzine faced Thursday.

Corzine was careful to testify that he never "intended" for client money to be misused. That's because intent is a key requirement of criminal prosecution, Frenkel said.

"If someone intended to violate (rules requiring the separation of client accounts), then the conduct is criminal," he said. "If it was unintentional, we are only in the zone of civil enforcement, if that."

If Corzine or others at MF Global are found guilty of civil violations, they might have to pay financial penalties.

One regulator raised the possibility Thursday that crimes were committed. As a primary dealer, MF Global made trades with the Federal Reserve Bank of New York. As the firm's finances worsened in its final weeks, the New York Fed required MF Global to put aside more money to cover the Fed's losses in case the firm failed.

New York Fed General Counsel Thomas Baxter testified that MF Global gave "express representation in writing" that the money it put up was not from client accounts.

"If that representation turns out to be false, a federal criminal offense has been committed," Baxter said.

Michael Greenberger, a professor at the University of Maryland School of Law and a former regulator, said the hearings resolved none of the questions surrounding MF Global's failure.

"Regulators' enforcement divisions and the Justice Department will work together because if the money is missing, somebody did something wrong," Greenberger said.

And given the damage done by MF Global's failure, there's little Corzine can do to revive his public image, said Michael Robinson, a former SEC official who now works in crisis communications.

"Unless Jon Corzine can look under the mattress in his house and find $1.2 billion to give back to customers, his reputation is beyond repair," Robinson said.

He noted that Corzine spent a career branding himself as an effective manager. Corzine rose from the trading floor of Goldman Sachs to become the investment bank's co-chairman. He then ran successfully for the U.S. senate and one term as governor of New Jersey. Corzine joined MF Global shortly after losing his bid for a second term.

Now, to protect himself legally, Corzine must avoid being precise about what occurred at the firm he led until last month. That's why many legal experts had expected Corzine to invoke his Fifth Amendment right against self-incrimination. He never did.

Much of Corzine's testimony Thursday involved an allegation that he knew about customer money that may have been transferred to a European affiliate just before MF Global collapsed.

"I did not instruct anyone to lend customer funds to MF Global or any of its affiliates," Corzine told a House panel. He also said he didn't know about "the use of customer funds on any loan or transfer."

It was his first public appearance since Terrence Duffy, CME Group Inc.'s executive chairman, alleged Tuesday that he might have known about the $175 million transfer. MF Global traded on exchanges managed by CME Group.

According to Duffy, an MF Global employee told a CME auditor that "Mr. Corzine was aware" of the earlier transfer. Duffy said he referred the matter to the Justice Department and the Commodity Futures Trading Commission.

The transaction Duffy described wasn't necessarily illegal. Brokers such as MF Global are allowed to borrow from customer accounts temporarily in some circumstances ? to reduce their own risk, for example.

But such cases are a narrow exception. A firm couldn't use customer money to pay trading partners if its speculative trades lost value. Even in cases where borrowing clients' money was legal, the firm would have to replace it with a safe, cash-like investment such as a U.S. Treasury security.

Corzine also was questioned about whether he used his relationships with regulators to gain advantages for MF Global.

Corzine has been a major fundraiser for Democrats. He was co-chairman of Goldman Sachs Group Inc. In that role, he worked with two other Goldman executives at the time: Gary Gensler, now chairman of the CFTC, and William Dudley, now president of the Federal Reserve Bank of New York.

Gensler has recused himself from the investigation because of his long history with Corzine. Along with other Wall Street executives, Corzine lobbied Gensler and his staff last summer against a possible CFTC rule that would limited how their firms can invest clients' money. Afterward, the CFTC delayed adopting the rule until earlier this month.

Early this year, the Federal Reserve allowed MF Global to join an elite group of 22 dealers that help the government sell Treasury securities. The Fed did not assess MF Global to see if it was taking on too much risk. Instead, Fed officials relied on oversight by the CFTC, the SEC and others.

The role of primary dealer conferred on MF Global a seal of financial strength. It gave the firm a competitive edge and likely lowered the interest it was charged to borrow, experts said.

Asked whether he received privileged treatment from the regulators because of his connections, Corzine said, "We didn't ask for special treatment" from the Fed.

And he said, "I do not believe we were given special treatment" from the CFTC regarding the rule to limit firms' investments of customer funds.
